The first step in property division is to determine whether property is separate property or marital property. Next, the court will consider the age, health, employability, and financial need of each spouse as well as length of the marriage and other factors in order to determine each spouse’s fair share of the marital property. •    Child custody is a necessary part of the divorce process whenever minor children are involved. An agreement or ruling must be made on the physical and legal custody of each child. •    Child support is determined by completing a child support worksheet and finding the appropriate amount on Pennsylvania’s child support schedule. Once a child support order is issued, it is registered with Pennsylvania’s automated Child Support Enforcement System (PACSES). This System keeps track of payment information, leaving no room false accusations.

•    Alimony, also called maintenance or spousal support, is a legal obligation to provide financial support to a spouse following a divorce. Generally, alimony is awarded in longer marriages where one spouse was responsible for domestic duties. Many couples do not realize that alimony affects their tax liability. Payment of alimony is tax deductible while receipt of alimony is included in gross income.
